Scope
These terms apply to the sale of available works and to commissions from Sebastian Zaquiere (Montevideo, Uruguay), agreed through this site, by email or on social media. By confirming a purchase or commission, the client accepts them.
The works
All works are originals, painted by hand in acrylic and mixed media on cotton canvas with a wooden stretcher. They are delivered signed and unframed unless agreed otherwise. Images on the site are a guide: colour may vary with screen and light, and views in interiors are digital visualisations.
Prices and quotes
Prices are in US dollars (USD) and are confirmed in writing before each sale or commission. The written quote states whether it includes shipping, insurance and taxes.
Payment
Transfer to Uruguayan banks, credit and debit cards, Mercado Pago, Abitab, Redpagos, QR payment and cash in Montevideo. Methods for payments from abroad are confirmed case by case.
Buying an available work
A work is reserved with a 50% deposit, and the balance is paid on delivery. Until the deposit clears, the work may remain available to other clients.
Commissions
The process is: a conversation; a written proposal with size, reference palette, price and estimated timeline; a 50% deposit to reserve; painting in the studio; and delivery against payment of the balance. The timeline starts when the deposit clears.
Every work is unique: a commission follows the agreed proposal but does not reproduce an earlier work or a reference image exactly.
Changes and cancelling a commission
Before painting begins, the client may cancel the commission and the deposit is refunded in full. Once the work has begun, the deposit is not refundable, because it covers materials and work already done. Major changes requested after the proposal is approved, such as a different size or palette, may change the price and timeline.
Right of withdrawal
If you buy an available work at a distance, without seeing it in person, you may withdraw from the purchase within five business days of delivery, under Article 16 of Uruguayan Consumer Protection Law No. 17.250. The work must be returned in the same condition and packaging, and the amount paid is refunded. Commissions, made to the client's instructions, follow the cancellation policy above, without prejudice to any rights the law gives you.
Shipping and delivery
In Montevideo, delivery can be arranged in person. Elsewhere in Uruguay and abroad, the work travels packed with corner and surface protection, by carrier or courier. Shipping cost, insurance and timing are quoted before confirmation.
For international shipments, import taxes and duties in the destination country are paid by the client. If agreed, large works can be shipped off the stretcher, rolled in a tube.
Damage in transit
If a work arrives damaged, let us know within 48 hours of receipt and send photos of the packaging and the work, so a claim can be made with the carrier or insurer.
Authenticity
Every work is delivered signed. On request, a signed certificate of authenticity is issued, with title, dimensions, medium and year.
Copyright
A purchase transfers ownership of the physical work, not the copyright, which the artist retains under Uruguayan Law No. 9.739. The artist may photograph and show the work, including commissioned works, in his portfolio, social media and exhibitions, without naming the client unless the client agrees. The works and the images on this site may not be reproduced for commercial purposes without written permission.
Caring for the work
Hang the work indoors, away from direct sunlight, heat sources and damp. Clean it only with a soft, dry cloth.
Governing law
These terms are governed by the laws of Uruguay. Any disagreement will first be settled in good faith; failing that, the courts of Montevideo have jurisdiction, without prejudice to the rights the law gives consumers.
